تنظيم العقار الاقتصادي كآلية لتحفيز الاستثمار وتحقيق التنمية الاقتصادي - "قراءة في جملة من القوانين المتعلقة بالعقارات والعقار الاقتصادي"

Abstract

يكتسي ملف العقار الاقتصادي أهمية بالغة حول قضية إنعاش الاقتصاد الوطني، وجذب الاستثمارات بكافة أشكالها، حيث تعول الحكومة على دعم المستثمرين لتطبيق مشاريعهم على أرض الواقع، من خلال استثمار رؤوس أموالهم وكفاءاتهم وقدراتهم، خاصة في مجال استغلال العقار الاقتصادي والسير نحو تحرير المعاملات الاقتصادية بغية إزالة كافة العراقيل التي ميزت المعاملات العقارية سابقا، وهذا بالأساس لخلق تكامل العقار الاقتصادي مع قانون الاستثمار. حيث تهدف هذه الدراسة إلى الوقوف على جملة من القوانين المنظمة للعقارات بكافة أشكالها، والتي تعامل بالتكامل مع القانون الجديد الذي جاء به المشرع الجزائري في مجال تنظيم العقار الاقتصادي، وذلك تحقيقا للأهداف التنموية التي يسعى إليها المشرع الجزائري لجذب الاستثمارات. ولقد اعتمدنا في هذه الدراسة على المنهج الوصفي بإعطاء وصف للحقائق القانونية التي عالجت موضوع الدراسة لاستخلاص موقف المشرع الجزائري حول مشكل العقار الاقتصادي بغية تجسيد تنقية مناخ الاستثمار، إلى جانب المنهج التحليلي لتحديد النظام القانوني للعقار الاقتصادي الموجه للاستثمار من خلال تحليل النصوص القانونية المتعلقة بموضوع الدراسة. The important economic real estate file and the issue of reviving the national economy and attracting many investments have their options, as the government relies on supporting investors to implement their projects on the ground, by investing their capital, competencies and capabilities, especially in the field of economic employment and moving towards economic transactions, removing all obstacles that characterized real estate transactions previously, and this is basically to understand the integration of investment and investment law. This study aims to identify a set of laws regulating real estate in all its forms, which are dealt with in integration with the new law introduced by the Algerian legislator in the field of regulating economic real estate, in order to achieve the development goals sought by the Algerian legislator to attract investments. In this study, we relied on the descriptive approach by providing a description of the legal facts that dealt with the subject of the study to extract the position of the Algerian legislator on the problem of economic real estate in order to embody the purification of the investment climate, in addition to the analytical approach to determine the legal system of economic real estate directed to investment by analyzing the legal texts related to the subject of the study.
