Abstract

The pharmaceutical industries play a major role in achieving the country's general policy goals by achieving the health safety of its citizens by establishing a healthy defense system, attracting foreign investment and promoting economic development. The pharmaceutical industry is closely linked to the rules of innovation and the provisions of technology, which are the ideal image and basic system for patent protection. In the face of international developments that countries have taken in the pharmaceutical industry, after adopting the TRIPS Agreement and including pharmaceutical industries within the elements of trade-related industrial property, Algeria has endeavored to decide a system for this type of industry under patent rules, and to regulate its legal provisions in order to achieve the goals It seeks in line with the provisions of the TRIPS Agreement in anticipation of joining the World Trade Organization, in line with the philosophy of liberalizing and developing international trade competition.تلعب الصناعات الدوائية دورا كبيرا في تحقيق أهداف السياسة العامة للدولة من خلال تحقيق السلامة الصحية لمواطنيها عن طريق إنشاء منظومة دفاع صحية، وجذب الاستثمارات الأجنبية وتعزيز التنمية الاقتصادية. وترتبط الصناعات الدوائية ارتباطا وثيقا بقواعد الابتكار وأحكام التكنولوجيا، والتي تعتبر براءة الاختراع الصورة المثلى والنظام الأساسي لحمايتها. وأمام المستجدات الدولية التي انتهجتها الدول في مجال الصناعات الدوائية، وذلك بعد اعتمادىها لاتفاقية تريبس وإدراج الصناعات الدوائية ضمن عناصر الملكية الصناعية المرتبطة بالتجارة، فقد سعت الجزائر لتقرير نظام خاص بهذا النوع مين الصناعات بموجب قواعد براءة الاختراع ، وتنظيم الأحكام القانونية الخاصة يها من أجل تحقييق الأهداف التي تسعى إليها تماشيا مع أحكام اتفاقية تريبس تحسبا للانضمام إلي منظمة التجارة العالمية بما يتماشي وفلسفة تحرير وتطوير المنافسة التجارية الدولية.
