Abstract

مع تزايد التقدم الصناعي والتكنولوجي والعلمي، تزايدت معه الأضرار الإيكولوجية، الأمر الذي جعل الباحثين والمهتمين بالمسؤولية القانونية المدنية يتجهون نحو إرساء أسس حديثة لإقرار المسؤولية المدنية عن الأضرار البيئية لمتابعة ومعاقبة مرتكبيها، وذلك باستنباطها من القوانين البيئية المعترف بها في التشريعات الداخلية والمستمدة من الاتفاقيات الدولية والإقليمية، وعليه فان هذه الورقة البحثية تهدف إلى تسليط الضوء على المبادئ المستحدثة في مجال المسؤولية المدنية عن الأضرار البيئية With the increase in industrial, technological and scientific progress, ecological damages have increased, which has led researchers and those interested in civil legal liability to move towards establishing modern foundations for establishing civil liability for environmental damages to pursue and punish their perpetrators, by deriving them from environmental laws recognized in domestic legislation and derived from international and regional agreements.
