التزامات دول ما بعد النزاعات غير الدولية اتجاه حقوق الإنسان

Abstract

تقع على عاتق البلدان الخارجة حديثا من النزاعات المسلحة غير الدولية التزامات يجب الوفاء بها، وتتمثل هذه الالتزامات في وجوب العمل على معالجة الآثار الجسيمة لحقوق الإنسان الناجمة عن النزاع، وذلك عن طريق إشراك جميع الأطراف في حل الأزمة، ومعرفة حقيقة ما جرى، والعمل على جبر ضرر الضحايا ومساءلة المتهمين فيها، كما يقع على عاتق هذه الدول التزام بضرورة العمل على وضع ضمانات عدم تكرار الانتهاكات الجسيمة لحقوق الإنسان مستقبلا، وذلك عن طريق إصلاح التشريعات والمؤسسات التي ساهمت في النزاع، والعمل على تحقيق التنمية. Countries newly emerging from non-international armed conflicts have obligations that must be fulfilled, and these obligations are represented in the need to work to treat the grave effects on human rights resulting from the conflict, by involving all parties in resolving the crisis, knowing the truth of what happened, and working to redress Victims that are harmed and those accused are held accountable. These countries also have an obligation to work on ensuring that grave violations of human rights will not be repeated in the future, by reforming legislation and institutions that contributed to the conflict, and working to achieve development.
