صحة التراضي في عقد البيع الإلكتروني

Abstract

جاءت هذه الدراسة لبحث صحة التراضي في عقد البيع الإلكتروني من خلال تحديد مختلف الإشكالات التي تحيط به قصد رصد الحلول التشريعية المقدمة من المشرع الجزائري، بغرض بيان مدى كفايتها على حل هذه المسائل، وفقا لمنهج تحليلي لمختلف القواعد المرتبطة بعقد البيع الإلكتروني سواء العامة منها أو الخاصة بالمعاملات الإلكترونية، لتصل الدراسة في الأخير إلى أن المشرع الجزائري قد قدم قدرا معقولا من الحلول القادرة على ضمان صحة التراضي في عقد البيع الإلكتروني.This study aims to research the validity of consent in the electronic sales contract throught the determination of the different problems that it generates with the aim of relating the solutions adopted by the Algerian legislator in order to demonstrate their adequacy to resolve these problems following the analytical method of the different rules, general relating to the electronic sales contract, or special to electronic transactions. Finally, the study resulted in the Algerian legislator printing so many solutions capable of guaranteeing the validity of consent in the electronic sales contract.
