العقار الاقتصادي وأثره في تشجيع الاستثمار الأجنبي في الجزائر - دراسة في ظل القانون 23/17

Abstract

يعتبر العقار الاقتصادي من بين أبرز العوامل المساهمة في تطوير الاستثمار بشكل عام، والاستثمار الأجنبي بشكل خاص، من خلال دوره في استقطاب المشاريع وجذب المستثمرين، لذا سعى المشرع الجزائري عبر مختلف النصوص القانونية إبراز الآليات القانونية لاستغلاله، كان آخرها القانون 23/17 الذي يحدد شروط وكيفيات منح العقار الاقتصادي التابع للأملاك الخاصة للدولة والموجه لإنجاز مشاريع استثمارية، وكذا المرسوم 23/486 الذي يحدد مكونات العقار الاقتصادي، والمرسوم 23/487 الذي يحدد شروط وكيفيات منح الامتياز القابل للتحويل إلى تنازل على العقار الاقتصادي. ونهدف من خلال هذه الدراسة إلى إبراز مدى قدرة الآليات القانونية المنظمة للعقار الاقتصادي والمتمثلة بالخصوص في القانون 23/17 في جذب الاستثمار الأجنبي المباشر وتحسين مناخ الاستثمار في الجزائر. Economic real estate is one of the key factors contributing to the development of investment in general and foreign investment in particular, as it plays a crucial role in attracting projects and investors. In this context, the Algerian legislator has sought, through various legal texts, to establish mechanisms for its utilization, the most recent being Law 23/17, which defines the conditions and procedures for granting economic real estate belonging to the state’s private domain for investment projects. Additionally, Decree 23/486 specifies the components of economic real estate, while Decree 23/487 sets out the conditions and procedures for granting a concession that can be converted into a transfer of economic real estate. This study aims to examine the effectiveness of the legal mechanisms governing economic real estate, particularly Law 23/17, in attracting foreign direct investment and improving the investment climate in Algeria.
