روح القانون: إشكالية المفهوم وجدلية التّوظيف

Abstract

الملخص: تقوم هذه الدراسة على تحليل مصطلح "روح القانون"، والبحث في بعده الوظيفي في المعرفة القانونية؛ تمهيدا لفقه مضمونه وتحقيقًا لاكتمال نُضجه ورُسوخ دلالته، وهو طرحٌ يَتشوّف لإمكانية ترشيح المصطلح إلى التعميم حتى يختزل سائر ما يتّصلُ به من اصطلاحات، وفي المقام الثاني بعد تجاوز معضلة الاصطلاح يَتوجّهُ الاشتغال ببناءِ أسُسِه العلمية، وترسيخِ مناهجهِ الوظيفية، حتّى تستوعب أسئلة الواقع الموجود، وتنهض بالتّجديد القانوني المنشود. الكلمات المفتاحية: روح القانون؛ المقاصد؛ المفهوم؛ التوظيف. Abstract: The current study aims to investigate the analysis of the term "spirit of law", and explore its functional dimension in legal knowledge. Owing to achieving the completion of its maturity and establishing its significance, the researcher paved for the jurisprudence of its content. The study was conducted to aspiring the possibility of nominating the term"spirit of law" to generalization so that it can be reduced to all related terminology. The study also aims at structuring its scientific foundations and consolidating its functional methods, so that it could get around the queries of the existing reality, and could promote the desired legal renewal.
