Abstract
The Algerian real estate legal framework has outlined and defined procedures and systems for the publicity of various claims and judicial decisions pertaining to real property. With respect to real estate claims, the Algerian legislature has granted a scope for challenging publicity rights. Despite the evidentiary strength of the real property publicity system adopted by the Algerian legislature, it does not purge publicity rights of their defects. On this basis, it grants individuals adversely affected by publicity rights the right to seek contestation. The legislature has mandated that real estate claims be subject to marginal notation on the property card, in accordance with Article 72 and Article 85 of Decree No. 76/63 dated March 25, 1976. Regarding the publicity of judgments and judicial decisions, these are also subject to real estate publicity procedures, as stipulated in Article 14, Paragraph 2 of Ordinance No. 75/74 dated November 12, 1975.
