"مَعالمُ النقْد الفقهي عند الإمام ابن بزيزة التونسيّ (ت 662هـ) من خلال كتابه: "روضة الـمُستبِينِ في شرح كتاب التَّلقينِ

Abstract

يَروم هذا البحث الكشفَ عن مَعالم النقد الفقهي وملامحِه عند الإمام ابن بزيزة التونسي من خلال مُصنَّفه "روضة الـمُستبين في شرح كتاب التلقين"، فاستفتحْتُه بتمهيد ضمّنتُه إضاءة عن حياة الإمام ومكانتِه العلميّة، وتلا ذلك أربعة مباحث: المبحث الأوّل وفيه تعريف بماهية النقد الفقهي. وأتبعتُ ذلك بالثاني، وفيه كشفْتُ مؤهِّلاتِ هذا النقد وروافدَه عند الإمام، وضمّنتُ المبحث الثالثَ أنواع النقد الفقهي التي مارسها، والمتمّثلة في النقْدينِ الداخلي والخارجي، وفصّلتُ الحديث في ذلك مع التمثيل، وبيّنت في المبحث الأخير الأدواتِ والآلياتِ التي اعتمدها الإمام ابن بزيزة في نُقوده مِن مُقرّرات اللغة، ومقتضَيات العقل، والجدل والحوار، وأصول الفقه، والقواعد الفقهية، وروحِ التشريع ومقاصده، كلُّ ذلك مع إعطاء أمثلة تطبيقيّة. وفي الختام توصّلتُ إلى نتائجَ مُستَصفاة من البحث، وتوجّتُ الدراسة بمُقترَحات وتوصيات يُرجى الأخذُ بها.

This research aims to reveal the features and characteristics of jurisprudential criticism according to Imam Ibn Baziza al-Tunisi through his work “Rawdat al-Mustabin fi Sharh Kitab al-Talqin”. First of all, the introduction gives an overview of the Imam's life and scholary status. Next come four sections: The first section incudes a definition of the jurisprudential criticism nature. The second section highlights the qualifications and tributaries of this criticism according to the Imam. The third section discusses the jurisprudential criticism type that he applied, represented by both internal and external criticism. This discussion has been detailed with exampels .The final section exhibts the tools and mechanisms that Imam Baziza adopted in his criticism, including language decisions, reason requirements, debate and dialogue, jurisprudence principles and rules and legislation spirit and objectives, all while giving practical examples. In conclusion, comprehensive outcomes have been reached from the research and the study has been concluded with suggestions and recommendations that should be taken into consideration.
