Abstract

إن أهم ما يميز العقد الإلكتروني هو أن تبادل التعبير عن الإرادة يتم بواسطة وسائل حديثة وعن بعد دون حضور مادي للأطراف في مجلس العقد وقت انعقاده. أمام هذه الخصوصية، التي تميّز العقد الإلكتروني عن العقد التقليدي، فإن القواعد العامة للعقود وجدت نفسها عاجزة للإحاطة بكل مستجداته. لذا سارعت معظم الدول لإصدار تشريعات تتلاءم مع هذا المولود الجديد من العقود وما يمتاز به من خصوصية، لاسيما أمام الانتشار الواسع لمثل هذه العقود. The most important feature of the electronic contract is that the exchange of expression of will is done through modern means and remotely, without material presence of the parties to the contract board at the time of its conclusion. Faced with this peculiarity, which distinguishes the electronic contract from the traditional one, the general rules of the contracts proved to be incapable of apprehending all its novelties. Most countries have therefore begun to enact legislations appropriate to the newborn contracts and its distinctiveness, This was due to the generalization of such contracts.
