Abstract

The legislator's inclination and preference for imposing moderate penalties in the realm of business crimes, predominantly characterized by financial aspects, stem from the recognition of the ineffectiveness of harshness in achieving the objectives of punishment. Financial penalties in the field of finance and business are capable of achieving deterrence and bringing economic benefit to the public treasury. This is a precursor to moving away from the punitive nature in the business sector and the emergence of new concepts to counter the negatives of legislative inflation or the penal legislative frenzy, which has become an obstacle to the entrepreneurial spirit among business operators.
