الحق في مستوى معيشي لائق بين الالتزام بحظر اتخاذ تدابير تراجعية وإجراءات التقشف

Abstract

يتطلب اعمال الحق في مستوى معيشي لائق كغيره من الحقوق الاقتصادية والاجتماعية والثقافية التزام الدول بمجموعة من الالتزامات، من بينها الالتزام بحظر اتخاذ تدابير تراجعية وذلك حتى في أوقات وجود قيود شديدة على الموارد، سواء بسبب عملية التكيف أو بسبب الانتكاس الاقتصادي أو غير ذلك من العوامل. إلا أن هذا الالتزام غالبا ما لا يتم احترامه من قبل الدول عند إقرارها لإجراءات التقشف كحلول لمواجهة الأزمات الاقتصادية التي تتعرض لها. The realization of the right to an adequate standard of living like other economic, social and cultural rights requires the commitment of states to a range of obligations, including the obligation to non- retrogressive measures, even in times of severe resources constraints, whether caused by a process of adjustment of economic recession or by other factors. But this commitment is often not respected by states when adopting austerity measures as solution to confront the economic crises.
