تزاحم أنظمة المسؤوليّة المدنية المترتّبة عن فعل القاصر

Abstract

إنّ تحميل القاصر المميّز لمسؤوليّة شخصيّة متنوعة حسب مصدرها من جهة، وتولية أمر الرقابة لمتعهدين قانونيين أو اتفاقيين من جهة أخرى يجعل التزاحم واقعاً على صعيد الأنظمة المختلفة للمسؤوليّة التقصيرية بداية، وبينها وبين المسؤوليّة العقديّة في إطار المسؤوليّة المدنيّة عمومًا، ومن ثم فإن معالجة الخيرة وكيفيات إحداث الموافقة الموضوعية والإجرائية بين شتى انواع المسؤولية المدنية المترتبة على فعل القاصر يجد محله كموضوع جد هام، لم تبين الإرادة التشريعية موقفا حاسما تاركة المجال للقضاء ومن وراءه الفقه. The imposition of diverse personal liability on a minor, depending on its source, alongside the delegation of oversight to legal or contractual agents, creates a competitive landscape among various systems of tort liability initially, and between tort and contractual liability within the broader context of civil liability. Consequently, addressing the nuances and methods of establishing both substantive and procedural consent across the different types of civil liability arising from a minor's actions emerges as a significant topic. The legislative intent has not provided a definitive stance, leaving the interpretation to the judiciary and, subsequently, to legal scholarship.
