Abstract

يعتبر محافظ الحسابات هيئة رقابية مستقلة استحدثها المشرع الجزائري بموجب المرسوم التشريعي رقم 9308- يحقق بها ازدواجية التسيير في شركة المساهمة نظرا لما تعرفه هذه الأخيرة من خصوصية، نظم المشرع هذه المهنة بقانون خاص نظرا لما يلعبه هذا الجهاز من دور في المجال الرقابي على حسابات الشركة والهيئات والسعي نحو معرفة ما مدى انتظام هذه الأخيرة ومطابقتها لأحكام التشريع المعمول به. ومن البديهي أنه بمنح جهاز محافظ الحسابات مهمة الرقابة على شركة مساهمة تولد علاقة تربط بينه وهياكل الشركة، مما يوسع من صلاحيات مندوبي الحسابات بشكل يحقق فعالية في الرقابة خاصة أن شركة المساهمة شركة ذات رؤوس أموال ضخمة وعامل للاستثمار وذات دور في الاقتصاد الوطني هذا من جهة، وتفاديا لأي تعسف يصدر من أجهزة التسيير من جهة أجرى.The auditor is considered an independent supervisory body created by the Algerian legislator pursuant to Executive Decree 93-08 with which he achieves dual management in the joint-stock company due to the privacy of the latter.
