سياسة التجريم والعقاب لمواجهة جريمة الإختلاس وفق القانون الجزائري رقم 06-01

Abstract

يعرف الفساد إنتشاراً واسعاً في جميع دول العالم، فقد أصبح ظاهرة تستدعي تظافر مجهودات الدول لتصدي لها، لذا قامت الجزائر بالإنضمام والتصديق على العديد من الإتفاقيات الخاصة بمكافحة الفساد، وخصصت لهذه الجرائم قانون مستقل هو القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، ونجد من ضمن هذه الجرائم جريمة الإختلاس في كل من القطاع العام والقطاع الخاصCorruption is proliferating in all countries of the world. Indeed, it has become a phenomenon that requires the synergy of efforts of all states to counter it. Thus, Algeria has acceded and ratified several anti- corruption treaties and dedicated a standalone law to the crimes related to it, dubbed law No. 06-01 on the prevention and fight against corruption. Among these crimes, we can note embezzlement in both the private and public sectors
