التوقيع الالكتروني كآلية لحمـايـة المعامـلات الالكترونيـة

Abstract

إنّ التحول نحو الحكومة الالكترونية أصبح مطلباً مُلحاً، خاصة في ظل الاعتماد على شبكة الانترنت في جميع المعاملات الإنسانية، إلاّ أنّه لا يمكن الحديث على المعاملات الإلكترونية دون الحديث عن الثقة والأمان الواجب توفيرها لهذه المعاملات؛ وهذا ما يتيحه التوقيع الالكتروني. وتهدف هذه الدراسة إلى استعراض المفاهيم الأساسية للتوقيع الالكتروني وتطبيقاته المعتمدة في حماية المعاملات الإلكترونية على ضوء التشريع الجزائري والقوانين الدولية النموذجية الصادرة عن لجنة القانون التجاري الدولي لهيئة الأمم المتحدة والبرلمان الأوروبي. The transition to electronic government has become a pressing demand, especially in light of the reliance on the Internet in all humanitarian transactions, but he can’t talk to electronic transactions, without talking about the confidence and security to be provided for these transactions; this is achieved by electronic signature. The aim of this study is to review the basic concepts of electronic signature and its applications in the protection of electronic transactions; based on the Algerian legislation, and the Model International legislation adopted by the United Nations, and the European Parliament.
