-أثر مراعاة القصود في اجتهادات عمر بن الخطاب - دراسة تأصيلية تطبيقية

Abstract

يهدف البحث إلى بيان أهمية القصود في الشريعة ودورها في تنزيل الأحكام الشرعية عن طريق تحقيق المناط الكاشف عنها، كما يروم بيان التكامل المعرفي بين علم الأصول والعلوم الإنسانية؛ وذلك بتوضيح العلاقة بين تحقيق المناط الخاص وعلم النفس، والعلاقة بين العرف وعلم الاجتماع. هذا التكامل بين المعارف الشرعية والإنسانية يلتقي في الكشف عن القصود من خلال تتبع القرائن، وبيان أثرها في تغيير الأحكام الشرعية. كما يتطرق البحث لأهمية فقه عمر  ومسالكه الاجتهادية المختلفة التي تهدف إلى الوصول للحكم الشرعي الموافق لمقاصد الشارع من خلال مراعاة القصود، بتسليط الضوء على نماذج من اجتهادات عمر  المبنية على هذا المعنى والعمل على تحليلها، وبيان أثر مراعاة القصود ودورها في اجتهاده وتنزيله للأحكام الشرعية، وهذا ما أسهم إسهاما كبيرا في تحقيق المقاصد الشرعية.

This research aims to elucidate the importance of intentions in Islamic law and their role in the application of Sharia rulings through the ascertainment of the relevant factors that reveal these intentions. It also endeavors to demonstrate the cognitive integration between the science of Islamic jurisprudence and the humanities, by clarifying the relationship between the ascertainment of specific factors and psychology, as well as the connection between customs and sociology.

Moreover, the study explores the significance of the jurisprudential insights of Umar ibn Al-Khattab and his diverse methodologies of ijtihad intended to achieve the Sharia ruling that conforms to the objectives of the Islamic lawgiver by taking into account intentions. This aspect is illuminated through examples of Umar's ijtihad that are founded on this principle, analyzing them and highlighting the importance of considering intentions and their role in his ijtihad and in the application of Sharia rulings. This approach has significantly contributed to fulfilling the objectives of Sharia.
