الإفادة من نظام الـ"bot" لتفعيل صيغة "الحَكر" في الوقف الإسلامي

Abstract

ملخص تقوم فكرة عقد "البناء والتشغيل ونقل الملكية"(B.O.T)، على تسليم الدولة لمشاريعها الأساسية ومشاريع البنية التحتية لجهة خاصة، تلتزم هذه الجهة بإنشاء المشروع، وإدارته ثم استغلاله، لتحقيق الأرباح، كما تلتزم بإعادة المشروع للدولة مع نهاية مدة العقد، ويعتبر عقد الـ(B.O.T) صيغة من صيغ التمويل الرائدة في الوقت المعاصر. حاولت الدراسة المقارنة بين هذه الصيغة التمويلية وصيغة "الحَكر"، التي ابتكرها الفكر الاقتصادي الإسلامي، لتمويل استثمار الأوقاف التي تراجع ريعها وخرِب أصلها، والتي تقوم على تسليم أرض الوقف أو عمرانه لمن يقوم بعمارته، واستغلاله مدة من الزمن يعود بعد انقضائها الملك الوقفي لجهة الوقف. وخَلُصَت الدراسة إلى إمكانية الاستفادة من عقد " البناء والتشغيل ونقل الملكية"(B.O.T) لتطوير صيغة "الحَكر" الإسلامية وفق ضوابط شرعية، من أجل عمارة الأملاك الوقفية. Abstract The contract of "build-operate-transfer" (BOT), based on giving the state’s basic projects and infrastructure projects to spicial direction who is committed to this the establishment of the project, and his administration then exploited, for profits, is also committed to turn the project to the state with the end of the term of the contract, and the contract of the (BOT) formula of the leading financing formulas in the present time. this study tried to compare between these financing formula and the formula "HAKR", wich devised by Islamic economic thought, to finance investment endowments which fell proceeds and ruined their origin, which are based on the delivery of land endowment, who wanted to invertisment in period of time , this endowment deu to endowment direction. The study concluded that the possibility of benefiting from the "build-operate-transfer" (BOT) contract to develop the Islamic formula "HAKR" according to the legitimacy of controls, in order to Waqf Propertie Building.
