الشـروط الإستثنائيـة كمعيار مميّز لعقـد الصفقة العموميـة

Abstract

كل العقـود التي تبرمها الإدارة ليست عقودا إدارية، فرق جوهري بين العقود الإدارية وعقود الشريعة العـامة للإدارة. ولتمييز العقود الإدارية اعتمد الاجتهاد القضائي في القـانون المقـارن عدة معـــايير منها الشروط الاستثنائية وهو المعيــار الذي تناولناه بالدراسة لتمييز عقد الصفقة العمومية في ظل انكسار معيار المرفق العـــــام والمعيار العضوي الذي ما زال مجلس الدولة في الجزائر يعتمده .All the contracts concluded by the administration are not administrative contracts. A substantial distinction opposes the administrative contracts and the contracts of the common law of the administration. To distinguish the administrative contracts the jurisprudence in comparative law adopted several criteria among them the exorbitant clauses of which this study was dedicated to distinguish the contract of public market considering the decline of the criteria of the public and organic service that the Council of State in Algeria is constantly adopting
