دور الإدارة في تنظيم التوسع العمراني بموجب رخصة البناء

Abstract

تناولت هذه الدراسة بالأساس؛ السياسة المتبعة من طرف المشرع الجزائري الذي يسعى من خلالها إلى تحقيق توسع عمراني آمن وسليم وذلك بموجب رخصة البناء، التي اعتبرها كقيد من قیود المراقبة الخاصة بالعقار وقيد يرد على حق التصرف في العقار، حيث يبرز ذلك من خلال الدور الذي تلعبه الإدارة في حماية العمران وتكريس سياسة عمرانية واضحة ومنظمة تتماشى مع التوجهات الحديثة في منح رخص البناء، في ظل تكثيف الرقابة الميدانية الفعلية لكشف المخالفات، كل هذا بهدف تحقيق الموازنـة بين مصلحـة المـالك من جهـة والمصلحتيـن العامة والخاصة مـن جهة أُخـرى. كما تهدف هذه الدراسة بدورها إلى إبراز مجال تدخل الإدارة والآليات الممنوحة لها لتمكينها من حماية العمران وتكريس سياسة عمرانية واضحة ومنظمة لمنع البناء الفوضوي والحفاظ على الطابع الجمالي للعمران، من حيث تحديد الشروط أو الضوابط الواجب توفرها في مشاريع البناء قصد التحكم في التوسـع العمراني بطريقة فعالة ومحكمة. This study mainly deals with the policy followed by the Algerian legislator, through which he seeks to achieve safe and sound urban expansion, in accordance with the building permit, which he considered as a restriction on the real estate's monitoring and a restriction on the right to dispose of the real estate, as this is evident through the role played by the administration in protecting urbanization and establishing a clear and organized urban policy in line with modern trends in granting building permits, in light of the intensification of actual field supervision to detect violations, all this with the aim of achieving a balance between the owner's interest on the one hand and the public and private interests on the other hand. This study also aims to highlight the scope of the administration's intervention and the mechanisms granted to it to enable it to protect urbanization and establish a clear and organized urban policy to prevent chaotic construction and preserve the aesthetic character of urbanization, in terms of determining the conditions or controls that must be available in construction projects in order to control urban expansion in an effective and strict manner.
