إمتيـازات الإدارة فـي مرحلــة تّنفيـذ القـرارات القضـائيــة

Abstract

بالنظر إلى أهمية وخطورة وجسامة المسؤوليات التي تتحمّلها الإدارة، خاصّة في الأزمات والظروف غير العادية، فقد منحها المشرع مركزا مميّزا أثناء تنفيذ القرارات القضائية، يتمثل في عدم خضوعها لآليات ووسائل التنفيذ التي يخضع لها الأفراد العاديون، بالإضافة إلى اعترافه بسلطتها في الملائمة تجاه تنفيذ تلك القرارات، ومن ثم التذرع بمختلف الذرائع والعراقيل القانونية للإمتناع عن تنفيذ القرارات القضائية الصادرة ضدها، وهو ما يضرب في الصميم مصداقية دولة القانونية وفعالية الرقابة القضائية على أعمال الإدارة.In view of the importance, seriousness and gravity of the responsibilities of the administration, especially in crises and extraordinary circumstances, the legislator gave it a special status during the implementation of judicial decisions.
