Abstract

ظهر الفكر العقابي وتطور عبر مدارس عدة وتباينت العقوبة في أصلها وتنفيذها بين المدرسة التقليدية والمدرسة الحديثة وتميزت مدرسة الدفاع الاجتماعي في دورها لدعم أنظمة العدالة بالتميز في مبادئها وأهدافها، وذلك بالتأسيس لحقوق الأفراد داخل المجتمع من خلال النظر والبحث العلمي في فلسفة العقاب والبحث في مدى مشروعية تطبيق عقوبات سالبة للحرية كالسجن والحبس والتشريع لها، والنظر في تاريخ السياسة العقابية ومدى شمولية القاعدة القانونية.Punitive thought appeared and developed through several schools, and punishment differed in its origin and implementation between the traditional school and the modern school.
