حجز الملكية العقارية غير المشهرة

Abstract

يبحث المقال موضوع حجز الملكية العقارية غير المشهرة، وهي الآلية التي أقرَها المشرع الجزائري بموجب القانون 08/09، المتضمن قانون الإجراءات المدنية والإدارية، تخوَل للدائن إمكانية التنفيذ بطريق الحجز على الملكية العقارية للمدين التي لا تتوفر على سندات مشهرة بالمحافظة العقارية، ويتم ذلك وفقا لإجراءات خاصة واستثنائية مناسبة لهذا النوع من الملكيات العقارية ذات الانتشار الواسع في الجزائر، بما يكفل استيفاء الدائن لحقه الثابت في ذمة مدينه بمقتضى السند التنفيذي، وإن تطبيق هذه الآلية ينطوي على الكثير من المشقة خصوصا فيما يتعلق بالدقة في تحديد العقار محل الحجز، فضلا عن المخاطر المرتبطة بظهور المالك الحقيقي للعقار المحجوز، وهو ما يجعل الحجز على الملكية العقارية غير المشهرة يتسم بالظرفية، ريثما يتم الانتهاء من عمليات المسح العقاري لكامل التراب الوطني وتأسيس السجل العقاري على أسس واقعية سليمة، بما يُفضي إلى تحقيق وتكريس الائتمان العقاري المنشود. The present research paper discusses the issue of the seizure of unpublished real estate, a mechanism approved by the Algerian legislator under Law 08/09, which includes the code of civil and administrative procedure. It gives the creditor the possibility of executing by seizure the debtor's real estate property, which does not have publicized title deeds in the real estate registry. This is done in accordance with special and exceptional procedures appropriate for this type of real estate property that is widespread in Algeria, which ensures that the creditor receives his established right from his debtor under the executive document. The application of this mechanism involves a lot of difficulty, especially with regard to the accuracy of identifying the property subject to seizure, in addition to the risks associated with the emergence of the real owner of the seized property that makes the seizure of unpublished real estate property circumstantial, until the completion of the cadastral survey process for the entire national territory and the establishment of the real estate registry on sound and realistic foundations that leads to the achievement and consecration of the desired real estate credit.
