    Les systèmes illégitimes sont voués à l’effondrement, la transition démocratique devient alors inévitable. Cependant, la fragilité des institutions ne permet pas des alternatives pour un changement stable et durable. Maintes modèles s’offrent, mais se heurtent à la variabilité spatiotemporelle. Donc, en prenant en considération les particularités de la société, le constituant doit s’intervenir pour élaborer une constitution réaliste et juste. Illegitimate systems are doomed to fall, so democratic transition becomes inevitable. However, the fragility of institutions does not allow alternatives for stable change. Many models are available, but without efficacy. So , the constituent must develop a realistic and just constitution taking into account the particularities of the society.

    Les Lois électorales Et L’abstention En Algérie

    Le taux d’abstention demeure en hausse malgré les efforts du constituant, l’électeur est souvent convaincu que les résultats ne reflètent pas la volonté populaire. Bien que les manœuvres frauduleuses puissent les fausser, elles ne peuvent être la seule explication. Cela est, partiellement, dû au régime électoral même qui agit directement sur les techniques des calculs des voix et la répartition des sièges; et indirectement sur le fonctionnement des institutions au sein d’un système inadapté aux exigences du régime électoral. Sans le savoir, les électeurs sentent l’écart entre les suffrages exprimés et la répartition des sièges. Donc, l’opinion publique n’est pas exprimée correctement au cours des élections. Le problème s’approfondit en formant un gouvernement en minorité incapable d’exprimer la volonté populaire. رغم جهود المؤسس الدستوري، تبقى نسبة الامتناع في تزايد مستمر. إذ تكونت قناعة لدى الناخب بأن نتائج الانتخاب لا تعكس الإرادة العامة. بعيدا عن التزوير كوسيلة لتشويه العملية، فإن الدراسة تبحث في مدى كون النظام الانتخابي وراء ذلك من خلال أثره المباشر على طريقة حساب وتوزيع المقاعد، وغير المباشر على عمل المؤسسات داخل نظام لا يستجيب لمتطلبات المنظومة الانتخابية. هذا الفارق بين الأصوات المعبر عنها وتوزيع المقاعد يؤدي إلى عزوف الناخبين مما يتسبب في تكوين حكومة أقلية لا تعبر عن الإرادة العامة. The abstention rate continues to rise despite the efforts of the constituent. The voter is often convinced that the results do not reflect the popular will. Although fraudulent maneuvers can distort them, they cannot be the only explanation; the study examines the electoral system which acts directly on the techniques of vote calculations and the distribution of seats, and indirectly on the functioning of institutions within a system that is inadequate to the requirements of the electoral system. The voters feel the difference between the votes and the distribution of seats. So public opinion is not expressed properly during the elections. That’s why, a minority government will be installed.
