المحاكمة العادلة هي أحد الحقوق الأساسية للإنسان، وهي تقوم على توافر مجموعة من الإجراءات التي تتم بها الخصومة الجزائية في إطار حماية الحريات الشخصية وغيرها من حقوق الإنسان. وفي سبيل ذلك، يجب أن تتوافر مجموعة ضمانات منها ضمانة التقاضي على درجتين، هذه الأخير ة التي تعتبر لبنة أساسية في بناء النظام القضائي لكل دولة، ولذلك حرص على التأكيد عليها التشريع الجزائري وكذا مجمل الاتفاقيات الدولية والإقليمية.Fair trial is one of the basic human rights, and it is based on the availability of a set of procedures in which criminal litigation is conducted within the framework of the protection of personal freedoms and other human rights, and for this, there must be a set of guarantees, including the guarantee of litigation in two degrees, as an essential element in the building of the judicial system of each State. For this reason, both the Algerian ligislator and the international conventions tended to focus on it.
