Résumé:
إن مفهوم الضبط الاقتصادي بالمعنى الذي تحمله مهمة مجلس النقد والقرض في ضبط وتنظيم السياسة النقدية للدولة، تقوم أساسا على عنصري الاستقلالية والحياد الذي عمل قانون النقد والقرض على تأطيرهما القانوني من خلال نصوصه. غير أن مدى هذه الاستقلالية ليست بعيدة عن إثارة العديد من الصعوبات التي ترتبط أساسا بالاختصاص التنظيمي لهذه السلطة، وإمكانية إثارة مسؤولية الدولة نتيجة تدخلاتها في القطاع الذي يخضع لتنظيمها.
إن هذين العاملين المتمثلين في كل من الاستقلالية والمسؤولية يبرران وضع المشرع حيز التنفيذ لميكانيزمات رقابة خاصة على أعمال هذه الهيئة الضبطية، تأخذ شكل كل من المداولة الثانية، وكذا إمكانية طلب التعديل.
The conception of sustained economic regulation in Algeria is obviously its best example in the banking market regulator which is the council of money and credit built in the form of an independent administrative authority. This degree of independence does not go without some difficulties, due in particular to the regulatory power at its disposal and the possibility of engaging state responsibility, which justifies the establishment of a special control mechanism to the latter and which takes the form of the second reading and the possibility of a request for modification.
