أثر الاختلاف في تكييف النقود الورقية في أحكام المعاملات المالية

Abstract

لقد تطورت النقود في مراحل مختلفة انتهت إلى تدخل السلطات الحكومية في أمر إصدارها وتنظيمه، كانت تلك النقود في كل مرحلة من تلك المراحل تدل على حقيقة مختلفة عن غيرها، إذ تمثل في بعضها عروضا، وفي البعض الآخر قيمة نقدية ثمينة من غير الذهب والفضة الخ ... ولما كان الاختلاف في تكييف هذه النقود الورقية، وتحديد حقيقتها على ما هي الآن يؤثر في بعض الأحكام المالية، فإننا حاولنا في هذا المقال بيان حقيقة هذه النقود -بعد استعراض النظريات القائمة في هذا الشأن- وإعطاء الأحكام الشرعية المالية المتعلقة بالأوراق النقدية بناء على التكييف المختار لتلك الأوراق. Abstract: Money has evolved in different stages over to the intervention of government authorities in its issuance and regulation. Money in each of these stages was showing a different reality from a stage to another, accounting sometimes for offers, and in other times for a pricing monetary value other than gold, silver, etc. ... Since the differences in adapting paper money and the determination of their actual status are affecting some financial provisions, we tried in this work to reflect the reality of this money - after reviewing existing theories in this regard - and to give legal financial provisions related to paper money based on the chosen adaptation.
