الحجية القانونية للتوقيع الإلكتروني كدليل للإثبات

Abstract

إن التطور المعاصر كشف عن ظهور شكل حديث للكتابة والمحررات والتوقيع، هو الأسلوب الإلكتروني المساير للتطور المتزايد لوسائل التكنولوجيا الحديثة التي هيمنت على كافة جوانب الحياة المعاصرة، بما فيها الجانب القانوني، وعدم الإقتصار على المحرر الورقي والتوقيع بالأحرف، بل التحول إلى المحررات الإلكترونية التي تعتمد على دعامات غير ورقية مصحوبة بالتوقيع الإلكتروني، أي إيجاد البديل عن الطريقة التقليدية يحل محلها و يؤدي نفس وظائفها من حيث التوثيق و الاثبات، لذا فهذه الدراسة تهدف إلى التعرف على التوقيع الإلكتروني وتبيان حجيته في الإثبات وكذا النصوص القانونية الدولية والوطنية التي تنص على تلك الحجية. Abstract: The contemporary development revealed the emergence of a modern form of writing, editors and signature, which is the electronic method in line with the increasing development of the means of modern technology that have dominated all aspects of contemporary life, including the legal aspect, and not limited to the paper document and letter signature, but rather the transformation to electronic documents that depend on Paperless supports accompanied by the electronic signature, meaning finding an alternative to the traditional method that replaces it and performs the same functions in terms of documentation and proof, so this study aims to identify the electronic signature and demonstrate its authority in proof, as well as the international and national legal texts that stipulate that authenticity.
