الإجتهاد الإنتقائي في الفقه الإسلامي

Abstract

يعرض البحث قضية هامة من قضايا العصر تتعلق بالاجتهاد في أحد جوانبه، حيث تناول الاجتهاد الانتقائي بدراسة مستوفية شاملة، هذا الاجتهاد الذي تفرضه عدة عوامل في شتى العلوم و المعارف و إن تركزت الدراسة على المجال الفقهي بما يتطلبه المقام، فتناولت ضبط مفاهيمه من هذه الزاوية، و كذا تأصيله لمعرفة مدى مرجعيته الشرعية و التاريخية، و أهم الدوافع الداعية إليه و مجالاته، و بيان معالمه و مقوماته ثم معرفة مقاصده و غاياته. إن هذا الاجتهاد في باب الفقه ضرورة عصرية حتمية لحل مشكلات الأمة الإسلامية، كما أنه يعطي رؤية تجديدية لما ينبغي أن تكون عليه الممارسة الفقهية الصحيحة تجاه الاجتهادات الفقهية. و لأن هذا الاجتهاد مطلب مهم، فإن هذا البحث سعى لتقديمه في قالب منهجي و بصورة موضوعية؛ فهو لم يحظ بدراسة تنظيرية من قبل علماء العصر و إن دعوا إليه في غير موضع و عملوا به في تطبيقاتهم العملية و ممارساتهم الفقهية بمختلف صوره. This study displays an important issue of our time, related to diligence ''Ijtihad'' in one of its aspects, dealing with selective diligence through a comprehensive study. This kind of Ijtihad imposed by several factors in various sciences and knowledge. It focused on the domain of jurisprudence as it takes place, by indigenizing its concepts, as well as discussing its historical and legal authority, and its most important motives and fields, features and components, and then find out its purposes and objectives. The selective Ijtihad in modern jurisprudence is a very important way to resolve the inevitable problems of the Islamic nation. It also gives an innovative vision of what should be the practice of Islamic jurisprudence. Because of the requirement and importance of the selective Ijtihad, this study presented it in a systematic methodological and objective manner, taking in knowledge the insufficient amount of studies about the selective Ijtihad in modern researches, although they called to it in more than one position, and they used it in their applications process and jurisprudence practices in its several forms.
