التسهيلات القانونية لدخول مواد وأفراد الإغاثة الإنسانية في حالات الكوارث الطبيعية

Abstract

لقد أصبحت البيئة البشرية محفوفة بالمخاطر أمام ما يشهده العالم من كوارث، سواء كانت من صنع الطبيعة أو الإنسان، مما نتج عنه الحاجة الماسة للجهود الإنسانية الدولية للتخفيف من الآثار الجسيمة التي قد تخلفها هذه لكوارث، إلا أن هذه الجهود الإنسانية تعتريها عدة عقبات إجرائية تتمثل في إجراءات دخول مواد وأفراد الإغاثة إلى إقليم دولة المتضررة (تأشيرات الدخول، تراخيص العمل، التخليص الجمركي وغيرها من إجراءات الدخول في الظروف العادية)، وهذا بعد موافقة الدولة المتضررة على المساعدة. لهذا تم التركيز على موقف المجتمع الدولي مـن هذه الأحكام الإجرائية، هل تطبق إجـــراءات الدخول العادية لمواد وأفراد الإغاثة الإنسانية أم هناك استثناءات؟ من هنا تم تقسيم الدراسة إلى مطلبين الأول تنـاول الأحكام الإجرائية التي تسرع وتسهل دخـول مواد الإغاثة الإنسانية، أمــا المطلب الثاني فخصص للامتيازات والقواعد الإجرائية التي تحكم دخول أفراد الإغاثة الإنسانية وتحديد مركزهم القانوني، وهذا من خلال ما جاءت به الصكوك والاتفاقيات الدولية التي تضمنت في بنودها على إجراءات استثنائية وامتيازات وحصانات، وكذا ضمان امن وسلامة أفراد البعثات الإنسانية من اجل تنفيذ مهامهم على أكمل وجه للتخفيف من معاناة الإنسان.
