المواطنة كمؤشر للديمقراطية وكمسألة دستورية: الجزائر نموذجا

Abstract

تعتبر المواطنة بمعانيها المختلفة مسألة مرتبطة بالديمقراطية بالدستور، وكلما كانت هناك ديمقراطية أكثر كلما كان هناك احترام أكثر للمواطنة مما يجعلها مسألة دستورية بامتياز فالدساتير الحديثة لا يمكنها تجاوز الديمقراطية لأنها مرتبطة بمجموعة من الحقوق (المدنية والسياسية والثقافية والاجتماعي) وتعبير عن الحريات الأساسية وهذا ما يتضح من النصوص الدستورية للدول لاسيما الدستور الأمريكي والدساتير الجزائرية فكيف تظهر العلاقة بين المواطن والديمقراطية؟ وما مكان المواطنة في الدساتير الجزائرية؟ وهل يمكن الحديث عن تطوير المواطنة وتعزيزها على ضوء ما يسمى بالإصلاحات السياسية في الجزائر، وهل المواطنة مقياس ومؤشر على صحة منظومة حقوق الإنسان.Citizenship is considered with its different meanings to be connected to democracy and to the constitution. The more there is democracy, the more there is respect to citizenship wish makes it distinguishably a matter of constitutionalism. Thus, modern constitutions can’t surpass democracy because it is linked with a set of rights (civil, political, and social and cultural rights).Democracy, at the same times; is an expression of fundamental freedoms. This is what is going to be demonstrated through the constitutional texts especially the American and Algerian constitutions. How is the relationship is shown between citizenship and democracy and what is the position of citizenship in the Algerian constitutions (1963, 1989, 1996, and2008). We will talk about the development and promotion of citizenship in the light of political reforms in Algeria. Then, we will show whether citizenship is an index and a measure for healthy system of human rights and what are the elements and constituents of citizenship and how they are developed through history?
