تـحـولات الـوسـط العقـابـي وايـكـولـوجيـا العقـوبـة

Abstract

مثلت عصرنة وتحديث السجن مفارقة في مفاهيم العقاب وشكلت مطية لتحولات في الوسط العقابي، بل كانت بداية لخروج العقوبة السجنيّة عن ماهيتها وطبيعتها وهدفها الذي منهجته توجهات محلية تاريخية غير عالمية، وأسست لمفهوم عدم أهلية الجاني للعقاب بغير المفهوم المدني. وتم تحول الوسط العقابي إلى وسط يحمل مواصفات الوسط العادي بما فيه من إشكالات حياتية أدت إلى عدم صحية البيئة السجنية. هذا أفضى إلى طغيان جانب على اخر وإخلال بتوازنات أكدت دراسات حديثة عدم صحية تلك التحولات مؤداها عدم ايكولوجية العقوبة وتفضيل البيئة القديمة للسجن على البيئة المعصرنة، The modernization and the actualization of the carceral institution presents a paradox in concepts of punishment and form a ride to shifts in the carceral environment, more than that, they trigged the exit off the punishment concept from its purpose and what it is , they also took it away from its inner goal designed initially by local historical and none universal trends, on an other hand they gave birth to a concept of ineligibility offender punishable out of civil concept , thus the carceral institution was transformed into a normal like environment that holds its specifications such as healthy living witch led to an unhealthy carceral (environment) life. This also led to the supremacy of a side on the other one and an unbalanced stat, latest and recent studies confirmed the unhealthiness of those transformations regarding the concept of ecology of the punishment, preferring the old prison environment on then modernized one.
