Abstract

تعددت طرق إدارة المرافق العامة بتعددها وتنوعها، فالأسلوب الذي يصلح لإدارة وتسيير مرفق عام معين، قد يعجز عن تحقيق الفعالية المطلوبة لو اُعتمد لتسيير مرفقٍ آخر، ويتصدر عقد الامتياز أولوية العقود الإدارية التي تنهض بعبء التسيير عن الدولة، وإن كان عقود غير مسمىً، إلا أنّه نظم في عدة قوانين قطاعية، ما جعل من الأحكام المتعلقة به تتباين من قانون لأخر.The are many ways of managing the public services. A method that is suitable for the management and operation of a public service may not be able to achieve the required demands if it is adopted in the aperation of another public service. The concession contract is the priority of the administrative contract that carry the burden of management from the state, albeit an indefinite contract. Has been regulated in several sectoral laws, making the provisions related to it vary from law to law.
