Abstract

التنظيم المتناسق لمختلف أحناء الواقع المجتمعي، في ظل وضع انتقالي، يؤسس لبناء ديمقراطي راسخ ويمهد لهيكلة اقتصادية شفافة. التوفيق في إحداث التفاعل بين هذين المسارين، السياسي والاقتصادي، هو المحدد للشكل النهائي لما يعرف بدولة القانون بمبادئها الوظيفية الحديثة. أحد أهم أوجه دولة القانون هو التساوي في الفرص، الذي يضع كل الفاعلين، كل حسب استعداداته، في نفس نقطة الانطلاق، فاسح المجال للتنافس الحر والعادل، للحصول على المقام، ليفعل فعله. المقاول-من خلال استعداداته؛ كفاعل مستقل في الحصول على حاجاته؛ كمنشئ لتنظيم، متمثلا في مؤسسته، مسهما بذلك في تشكيل الفضاء العام ثم كمنتج للقيم الخالقة لعلاقات الضبط الأساسية داخل هذا الفضاء-لا يمكن تصوره إلا كمسهم في تشكل وتنمية المجتمع المدني الحداثي. محاولتنا هذه تهدف إلى المساهمة في النقاش المعرفي حول ميكانيزمات تشكل المجتمع المدني في ظل وضع انتقالي، ثم قياس فضل المقاولة كفعل نخبوي في المستوى الأول ودور الفرد المقاول، في مستوى آخر، كفئة مهنية-اجتماعية، في بروز وتنمية هذا المجتمع.The setting up of an assortment of rules of operations with good justification, under the transition provides the basis for a transparent structuring of the economy and a consolidated institutionalization of democracy. The interaction of the two processes will determine the final form of a state of law with its modern functional precepts. One of the allegorical facets of the rule of law is equality of opportunity, placing all actors, according to their disposal, at the same starting-point, leaving the freedom and equal race to take its merit. The entrepreneur - with his pre-requisite qualities, as the main player, independent of any dependence in the production of his subsistence; The creator of organizations forming the public space and the generator of values, establishing with this space the necessary relations of regulation - can only be an inspiration for the formation as well as the emergence of civil society. The objective of this contribution is to enlighten further the notion of formation of a transitional civil society ; Then measure the contribution of entrepreneurship as a state of mind in the first place and finally situate the entrepreneur as a new socio-professional category in the emergence of this company.
