الأمـن القضـائي بيـن ضمـانـات التشـريـع ومخـاطـر الاجتهـاد

Abstract

يكتسي الاجتهاد القضائي أهمية بالغة لكونه يكمل النقص الذي يشوب القاعدة القانونية، إلا أنه ورغم أهميته فإنه قد يؤثر سلبا على الأمن القضائي؛ لذا تسعى تشريعات الدول لوضع آليات تحقق التوازن بين متطلبات الأمن القضائي وحاجة القانون للاجتهاد والتطور. حاول المشرع الجزائري توفير ضمانات تضبط الاجتهاد، إلا أنها لم ترقَ بعد إلى المستوى المعمول به في تشريعات الدول الأخرى، ممّا يتطلب إنشاء ضمانات تحول دون المساس بالأمن القضائي وتحقق العدالة. Jurisdiction is of great importance because it complements the lack of legal basis, but despite its importance, it may have a negative impact on judicial security. Therefore, state legislation seeks to establish mechanisms that strike a balance between the requirements of judicial security and the law’s need for diligence and development. The Algerian legislator has tried to provide guarantees to regulate jurisprudence, but it has not yet reached the level of legislation in other countries, which requires guarantees that will prevent compromising judicial security and achieving justice.
