الشـراكة الأجنبيـة في قانـون الاستثمـار الجزائـري شـرط تميـزي أم حتميـة اقتصـاديـة؟

Abstract

كرس المشرع الجزائري بموجب قانون الاستثمار الحرية التامة في انجاز الاستثمارات، بشرط مراعاة التشريعات والتنظيمات المتعلقة بالنشاطات المقننة وحماية البيئة، إلا انه اتجه بموجب قانون المالية لسنة 2016 لتبني معيار أخر كشرط لقبول انجاز الاستثمارات الأجنبية وذلك بتقييد إنشاءها في إطار شراكة مع رؤوس أموال وطنية مقيمة. لذا يهدف هذا المقال إلى تبيان الأحكام المنظمة للشراكة الأجنبية في قانون الاستثمار الجزائري، وكذا الآثار المترتبة على تطبيق إجراء الشراكة كأسلوب وحيد لإقامة الاستثمارات الأجنبية في الجزائر. Under the law of investment promotion, Algerian legislator established the full liberty of realizing investments, provided that legislations and the regulated activities and environment protection must be respected. However, in finance law of 2016, he adopted another criterion as a condition to admit foreign investments, by restricting its achievement as part of partnership with resident national capitals. This paper aims to define the provisions governing foreign partnership in Algerian law of investment , and the effects resulting from the application of the procedure of partnership as a unique method of realizing foreign investments in Algeria.
