المهاجـر لأسبـاب ايكـولـوجيـة في إفـريقيـا في ظـل إشكـاليـة مـدى شمـوله بالحمـايـة القانونيـة

Abstract

تتعرض قارة إفريقيا إلى تهديدات ذات بُعد ايكولوجي، تنطوي على مخاطر التغير المناخي والظواهر الطبيعية الخطيرة كالتصحر والجفاف اللذان أصبحا يميزان القارة، ونتيجة لهذه الآثار السلبية أضحت شعوب القارة تهاجر إما داخل إقليم الدول المتضررة أو خارجها، مابين نازح ولاجئ بحثا عن ظروف أفضل للحياة أو بالأحرى للحفاظ على وجودها. إن هذا الوضع دفعنا للبحث في مدى إمكانية هذه الشعوب في الحصول على اللجوء لدى دول أخرى أو الاعتراف بهم كلاجئين على غرار اللاجئين المضطهدين الذين تناولتهم إتفاقية جنيف لسنة 1951. لذا قمنا بالبحث عن تعريف للجوء البيئي وعن السبل القانونية التي تكفل الحماية القانونية للاجئ لأسباب ايكولوجية في قارة إفريقيا إن وجدت .The African continent exposed to an ecological threats, involve the risk of climate change and natural phenomena such as desertification and drought, which have become characteristic of the continent, as a result of the negative effects, African people were pushed to migrate, either within the territory of the affected countries or outside, between displaced people and refugees seeking for a better life. This situation led us to search on extent possibility of these peoples to obtain refuge in other States, similar to the oppressed refugees who were been dealt with Geneva Convention of 1951. So we look after a definition to environmental refuge and on the legal Mechanisms to ensure the legal protection of refugees Motivated by ecological reasons if any.
