آليات التعاون الدولي والإقليمي الرامية للوقاية من الجرائم المرتكبة ضد الأطفال

Abstract

يلعب المجتمع الدولي دورا محوريا في تدوين القانون الدولي لحقوق الإنسان وتكريسه على أرض الواقع، ورفع مستوى تمتع بني البشر به عامة، والفئات الهشة خاصة الأطفال، إذ يعد هؤلاء محور الاهتمام الدولي، وهو ما أدى إلى إبرام عدد هائل من الاتفاقيات التي تتعلق بحماية الطفل وبيان حقوقه، وإيلاء الاهتمام للطفل الضحية خاصة، بحيث يعتبر الاعتداء على هذه الحقوق خرقا للقانون الدولي لحقوق الإنسان، تلتزم الدول المصادقة على الاتفاقيات المعنية بتجريمه واتخاذ التدابير اللازمة لكفالته، والاقتصاص من الفاعل. محاولة مكافحة الجريمة ضد الطفل والوقاية منها بطريقة فردية جعلت جهود الدول في إطار عدم التنسيق تبوء بالفشل، وهو ما استدعى التعاون والتنسيق بين الدول لحماية الطفل الضحية زمن السلم، وكذا في خلال النزاعات المسلحة حيث تكون معدلات الأطفال الضحايا مرتفعة، إلى جانب تجنيد الأطفال، وهي الجريمة المندد بها دوليا، كما تجدر حماية الطفل كذلك من إجراءات العدالة الشاقة. استفادت الجزائر من التعاون الدولي ورفعت نظمها القانونية ذات الصلة بحماية الطفل الضحية إلى المستوى المطلوب، وأهم ما يشار إليه بهذا الصدد هو آليات حماية الطفل ضحية الإرهاب، وقانون حماية الطفل رقم 15-12، إلى جانب التعديلات المتلاحقة لقانون العقوبات والدستور. The international community is playing a pivotal role in the codification of international human rights, and raise the level of it enjoyment of all human beings, and vulnerable groups especially children, they are in the focus of international attention, by the conclusion of a huge number of agreements, so that is the attack on these rights in breach of international human rights law, the ratifying countries are committed to criminalizing all breaches, and punishing the actors. Attempting to combat and prevent crime against children individually, the efforts of States doomed to failure, and is what cooperation and coordination between States summoned to protect the child victim in peace time, and as well as during armed conflicts where numbers of children victims are high, along with the recruitment of children, in the other hand the child must be protect from the justice process. Algeria has benefited from international cooperation and lifted their systems relevant to the protection of the child victim to the desired level, most of it is referred the legal mechanisms to protect the child victim of terrorism, and the Child Protection Act 15-12, and successive amendments to the Penal Code and the Constitution.
