إعمال الحق في التنمية

Abstract

مرت العلاقة بين حقوق الإنسان والتنمية بمرحلتين هامتين، حيث تميزت المرحلة الأولى باستبعاد حقوق الإنسان من عملية التنمية وسميت بمرحلة التضحية بحقوق الإنسان من أجل التنمية، أما المرحلة الثانية فقد أدمجت حقوق الإنسان في سياسات التنمية وعرفت بمرحلة توازن العلاقة بين حقوق الإنسان والتنمية، وخلال هاته المرحلة أثمرت المطالبات العديدة للدول النامية في المحافل الدولية لتأكيد حقها في التنمية بإعلان الأمم المتحدة للحق في التنمية عام 1986، والذي ينص في العديد من مواده أن الموضوع الرئيسي للتنمية هو الإنسان، وبالتالي فإعمال الحق في التنمية يتطلب تكريس عدد من المبادئ والحقوق الأساسية والتي هي ضرورية ولا يمكن انتهاكها خلال عملية التنمية، كما أن هذا الحق هو حق مكفول للشعوب والدول. وسنحاول في هذه الدراسة تبيان المتطلبات الضرورية لإعمال الحق في التنمية، والتي تتفرع إلى بعدان هما: البعد الداخلي والمتمثل في احترام حقوق الإنسان، والحق في المشاركة، والعدالة الاجتماعية، أما البعد الآخر وهو البعد الدولي والمتمثل في مبدأ السيادة على الثروات الطبيعية، والتضامن والتعاون الدوليين، ومبدأ السلم والأمن الدوليين. The relationship between human rights and development has gone through two important phases, with the first phase characterized by the exclusion of human rights from development. The second phase incorporated human rights into development policies. During this phase, the many demands of developing States in international forums to assert their right to development have been borne fruit by the 1986 United Nations Declaration on the right to Development, which in many of its articles states that the main theme of development is human beings. Thus, the realization of the right to development requires the dedication of a number of fundamental principles and rights that are necessary and cannot be violated during the development process, and that right is guaranteed to peoples and States. In this study we will try to identify the necessary requirements for the realization of the right to development, which are two dimensions: The internal dimension of respect for human rights, the right to participation, social justice, and the international dimension of sovereignty over natural resources, international solidarity and cooperation, and the principle of international peace and security.
