المضافات الغذائية بين حماية المستهلك والضرورات العملية - دراسة في التشريع الجزائري -

Abstract

تطورت الصناعات الغذائية بتطور استخدام المضافات في تكوينها فأصبحت ضرورة عملية وتجارية يعتمد عليها المتدخلين من صانعين ومنتجين بقصد جذب المستهلك الذي لا يدرك مدى الخطورة التي يمكن ان تحدثها هذه المضافات من أمراض خطيرة ومزمنة، وعليه تهدف الدراسة إلى تسليط الضوء على المضافات الغذائية من حيث أنواعها وشروط وكيفيات استخدامها كآلية لحماية المستهلك وفق ما نص عليه المشرع الجزائري. ورغم ما يستهدفه استعمال هذه المضافات في عملية تصنيع وتحضير الغذاء وإبقائه سليما ولتحسين طعمه ومظهره بغرض تحقيق أرباح معتبرة، إلا أن ما ينتج عن استعمالها قد يضر بصحة وسلامة المستهلك الأمر الذي دفع بالمشرع الجزائري كغيره من المشرعين بتسطير الاطار القانوني الخاص بضمان وأمن صحة المستهلكين فيما يتعلق بالمضافات الغذائية حيث قام بوضع الضوابط والشروط القانونية لاستخدامها بما فيها احترام النسب المسموح بها عملا بالمطابقة للمقاييس الدولية المعمول بها في هذا الخصوص، لكن ومع مع ذلك لا تزال مسألة المضافات الغذائية تهدد صحة المستهلك نتيجة خطرها على الجسم وتعددها بين المسموح والمحظور منها ما يجعل أمر ضبطها صعبا خاصة أمام تغليب المنتجين لمصالحهم الخاصة على حساب المستهلك. The food industry has evolved with the development of the use of additives in their composition to become a practical and commercial necessity on which the interventionists of manufacturers and producers depend in order to attract the consumer who does not realize the seriousness that these additives can cause from serious and chronic diseases, and therefore the study aims to highlight the Food additives in terms of their types, conditions and how to use them as a consumer protection mechanism, as stipulated by the Algerian legislature. Despite the aim of using these additives in the manufacturing process with what it achieves in the manufacture and preparation of food and keeping it healthy and to improve its taste and appearance in order to achieve significant profits, what results from their use may harm the health and safety of the consumer, which prompted the Algerian legislator like other legislators to underline the framework The law on ensuring and ensuring the health of consumers in relation to food additives where it has established controls and legal requirements for its use, including respect for the permissible ratios in accordance with applicable international standards in this regard, but nevertheless the issue of food additives continues to threaten the health of The consumer as a result of its danger to the body and its multiplicity between permitted and prohibited, which makes it difficult to control it, especially in the face of producers' preference for their own interests at the expense of the consumer
