التـنـميـــة... حــــق مـن حقــوق الإنســان

Abstract

يعتبر الحق في التنمية حجر الزاوية في الدراسات المتعلقة بحقوق وأمن الإنسان، خاصة وأن القرن الحالي يشهد تحديات تنموية واسعة الانتشار، كالفقر، التخلف والتبعية، مشاكل المديونية، التدهور البيئي...الخ. فمن غير المعقول أن يفكر الإنسان في أمنه ولا الدولة في أمنها في الوقت الذي يتم فيه تجاهل المشاكل التنموية، لذلك يعد تجّسيد الحق في التنمية مكسبا مهما للأفراد، الشعوب والدول، إلا أنّ الحق في التنمية كحق جماعي من حقوق الجيل الثالث يعد من أكثر طوائف حقوق الإنسان حداثة في أدبيات القانون الدولي لحقوق الإنسان وأكثرها جدلا خاصة بعدما تبنته الأمم المتحدة باعتمادها إعلان الحق في التنمية عام 1986، لذلك طرحت إشكالية مدى اعتباره حقا قائما بذاته في إطار منظومة حقوق الإنسان. ويتم في هذه الورقة البحثية طرح هذا الإشكال القانوني في محاولة للتأسيس للتنمية حق في منظومة حقوق الإنسان. However, the right to development as a collective right of third-generation rights is one of the most modern human rights groups in the literature of international human rights law, especially after the adoption by the United Nations of the Declaration on the Right to Development in 1986. And therefore raised the question of the extent to which it was considered an independent right within the framework of the human rights system. This paper presents this legal problem in an attempt to establish a right in the human rights system for development.
