القواعد الدستورية غير القابلة للتعديل في الدستور الجزائري

Abstract

تعتبر الدساتير المرآة العاكسة لإرادة الشعوب، ولما كانت هذه الإرادة غير ثابتة كان لزاما أن تسايرها الدساتير وتتغير بتغيرها، وفي نفس الوقت كان لابد من الحفاظ عليها من التلاعب من قبل الحكام عبر تعديلها وذلك بوضع قيود وضوابط من شأنها أن تغل يد الحكام عن تعديل الدساتير، وذلك ما يسمى فقهيا بنصوص حظر تعديل الدستور والتي أثبتت التجارب السياسية أنها تبقى محترمة وملزمة مادامت تتلاءم مع الإتجاهات السياسية لنظام الحكم السائد، وتصبح دون أية قيمة بتغير هذه الإتجاهات، الأمر الذي أثار جدلا فقهيا حول القيمة القانونية لهذه النصوص.constitutions reflect the will of people and since this will may be changed according to n eeds changing through the time it becomes necessary constitutions revision to still compatible with this will but at the same time the revision must be preserved from government intervention and manipulation for personnel aims by prevent texts revision which political experiences have shown that it remains respectful and binding as long as it conforms to the political trends of the prevailing system of government, and becomes without any value in changing these trends, which sparked a jurisprudential debate about the legal value of these texts.
