آليات مكافحة جرائم الفساد ومدى فعاليتها في التشريع الجزائري

Abstract

سعى المشرع الجزائري لمسايرة الجهود الدولية في مكافحة الفساد من خلال مصادقة الجزائر على الإتفاقيات الدولية المتعلقة بهذا الشأن، وهو الأمر الذي استوجب إعادة النظر في المنظومة القانونية الجزائرية بهدف تكييفها مع التزاماتها الدولية، وبالفعل أصدر المشرع القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته المعدل والمتمم، وقد كرس المشرع من خلاله جرائم الفساد، وبين آليات مكافحتها، والعقوبات المقررة لها، كما قام بإنشاء هيئات للوقاية من الفساد ومكافحته بناء على ما دعت إليه الإتفاقيات، ما يجعل هذا القانون إلى حد ما منسجم مع الإتفاقيات الدولية والإقليمية والعربية، إلا أن جرائم الفساد في تزايد مستمر وبشكل رهيب والمنظومة التي رصدها تفتقد لفعالية التطبيق وردع المفسدين. وتجب الإشارة أن الغاية من هذا المقال هو تبيين آليات مكافحة الفساد، وفي هذا الصدد تطرقنا لقوانين مكافحة الفساد سواء كانت في شكل إتفاقيات دولية، أو نصوص قانونية تشريعية أو حتى مراسيم تنظيمية، هذا في المحور الأول، ثم تطرقنا في المحور الثاني لهيئات مكافحة الفساد، وهما الهيئة الوطنية للوقاية من الفساد ومكافحته، والديوان المركزي لقمع الفساد The Algerian legislator aims international efforts to combat corruption, through Algeria's ratification of the international conventions in this regard, which necessitated reconsidering the Algerian legal system with a view to adapting its international obligations. The legislator has already enacted Law N° 06-01 on the prevention and control of corruption, Through the mechanisms of combating it, and the penalties imposed on it, and the establishment of bodies to prevent and combat corruption as called for by the conventions, which makes this law to the extent consistent with international and regional conventions, but the crimes of corruption is increasing and terribly and monitored system that lacks the effectiveness of the application and deter spoilers. It should be noted that the purpose of this article is to identify mechanisms to combat corruption, and in this regard we addressed the laws of combating corruption, whether in the form of international conventions, or legislative texts or even regulatory decrees, in the first axis, and then we discussed the second axis of anti- corruption bodies,The National Commission for the Prevention and Combating of Corruption, and the Central Office for the Suppression of Corruption.
