Abstract

الملخص: تناول هذا البحث أحد أعلام الفقه المالكي في القرن التاسع وهو الإمام والقاضي أبو القاسم عيسى بن ناجي التنوخي وإسهاماته في ساحة الفقه والقضاء، من خلال تسليط الضوء على أحد أخص القواعد الفقهية والقضائية وألصقها بالمذهب المالكي وهي "ما جرى به العمل"، وذلك بمحاولة تتبع إطلاقاته واستعمالاته لهذه القاعدة وتلمس بعض معالم العمل التونسي والإفريقي المستقر في عصره من خلال ما ينص عليه -رحمه الله- من "العمل"، كما يعرض البحث لاجتهاداته وتطبيقاته التي بناها في مجال القضاء على الأخذ بهذه القاعدة الفقهية، وهذا كله بالنظر في واحد من أهم مؤلفاته الفقهية الماتعة الرائعة وهو "شرح تفريع ابن الجلاب".
