فقه الموازنات وأثره في النوازل الفقهية المعاصرة -وسائل التواصل الاجتماعي أنموذجا-

Abstract

الملخص: تتناول هذه الدراسة دور فقه الموازنات في الحكم على مسائل النوازل الفقهية المعاصرة؛ حيث يكشف البحث بعض المرتكزات العامة التي يجدر بالفقيه اعتمادها في عملية الموازنة، حتى يكون تطبيقه للأحكام تطبيقا مقاصديًّا محققا لمصالح العباد في العاجل والآجل، من خلال فهم الواقع الذي يُنَزَّلُ عليه الحكم الشرعي والموازنة بين المصالح والمفاسد، وكذا التحقق من انطباق علة الحكم في النازلة المعروضة، مع اعتبار خصوصية بعض الحالات وما يعترضها من الضرورات و الاستثناءات، ومن هذا المنطلق تناولت الورقة البحثية أهمية فقه الموازنات في ضبط وتحديد الحكم الشرعي المناسب لاستخدام وسائل التواصل الاجتماعي باعتبارها من النوازل المستجدة في عصرنا الراهن. وأخيرا ينتـهي البحـــــث إلـــــى أن عملية الموازنـــة ضرب من ضروب الاجتـــــهاد في شقه التطبيقي، تحتاج لضوابط وآليات لتحديد الحكم المناسب تطبيقه على النازلة. Abstract: This study focused on the role of the jurisprudence of the coordination in the judgment of subjects concerning contemporary calamities jurisprudences .By the way, this research reveals some general pillars that the jurist should adopt in the coordination process so that its intentional application of the provisions is realizing eventually the interests of servants, by understanding the reality enduring the legal ruling with the balance between interests and spoilers. In addition, the verification of the concordance between the judgment reason of the exposed calamity taking into account the privacy of some cases and what obstructs it from necessity and exceptional cases, was been made. Finally, the research concludes that the coordination process is a form, which need controls and mechanisms to determine the first ruling applied to the clamity.
