المرجعية القيمية بين الانفتاح والانغلاق في التراث الفقهي المالكي - معيار الونشريسي أنموذجا

Abstract

الملخص: ترتبط المرجعية القيمية المنفتحة بالتراث الفقهي المالكي الذي انفتح على كل احتمالات التفسير من قارئ مثالي افترضه المؤلف صاحب المدونة الفقهية المالكية، أما المرجعية القيمية المنغلقة فهي ما ارتبط بالتراث الفقهي المالكي الذي سعى مؤلفوه إلى تمثل دور القارئ أو المستفتي أثناء عملية بناء التراث، وبالتالي فهو تراث يبيح التفسير ضمن حدود نصية معينة ومفروضة. ويتجلى هذا الانفتاح والانغلاق في المرجعية القيمية، كما في الإنتاج الفقهي المالكي لدى الونشريسي من خلال كتابه المعيار، ليكون معيارا مفتوحا في بعض مضامينه، مغلقا في البعض الآخر، بالنظر إلى التغيرات الجوهرية في النظام الفكري. الكلمات المفتاحية: الكاتب، القارئ، المرجعية القيمية المنفتحة، المرجعية القيمية المغلقة، القيمة، المرجعية، الونشريسي، المعيار. Abstract: The open valuable reference is linked to the close Malik’s jurisprudence heritage that is open to all interpretation probabilities based on an ideal reader proposed by the Malik’s jurisprudence record. Whereas, the close valuable reference one is related to the open Malik’s jurisprudence heritage. Here the author of the record plays the role of the reader or the follower during the process of heritage establishment. Therefore, this heritage allows interpretation within a certain textual boundaries. The openness and/ or closeness of the valuable reference is clear. This is mentioned within EL-WANSHARISSI book (EL-MIAAR), as an open book in some of its contents, and a close one in other times according to the core changes in the epistemic system.
