يعتبر مبدأ التدخل الإنساني من المبادئ التي أثارت جدلا فقهيا وقانونيا، ونقاشات كبيرة على مستوى تطبيقها، ويعود ذلك لكونه من المبادئ الحديثة التي ظهرت مع التطور والتغير في نمطية النظام الدولي، والتغيرات الجوهرية التي عرفتها العلاقات الدولية . كما خلق اعتماد مبدأ التدخل الانساني تعارضا واضحا مع المبادئ التقليدية للعلاقات الدولية مثل مبدأ السيادة، ومبدأ عدم التدخل في الشؤون الداخلية للدول الجدل المذكور سابقا جعل مبدأ التدخل الإنساني محل تحديد من حيث المفهوم والمعايير المعتمدة لتطبيقه.
