الاتجاهات الحديثة نحو إدارة الدعوى الجنائية "التسوية الجنائية نموذجا"

Abstract

.تعد التسوية الجنائية إحدى الآليات الحديثة والفعالة لفض النزاعات الجزائية والتي أفرزتها السياسية الجنائية المعاصرة في إطار سعيها المتواصل لإيجادوسائل وحلول للتخفيف من أزمة العدالة الجنائية المتمثلة في بطء إجراءات التقاضي نتيجة الزيادة الهائلة في عدد القضايا المرفوعة أمام المحاكم الجزائية، وذلك عن طريق تيسيير الإجراءات والتقليل من حكم القضايا القليلة الخطورة المعروضة على القضاء الجزائي . ومن بين التشريعات الجنائية التي تبنت هذا الآلية كبديل لإنهاء المتابعة الجزائية نجد التشريع الفرنسي، وذلك بموجب القانون 99- 515 الصادر في 23 يوليو 199 المعدل والمتمم لقانون الإجراءات الجنائية الفرنسي، الذي استحدثها كإجراء توفيقي تعويضي ورضائي يلتزم من خلاله الجاني القيام بجملة من التدابير ذات الطابع الجزائي مقابل انقضاء الدعوى الجنائية ضده. وتتضح أهمية الدراسة باعتبار أن التسوية الجنائية من أهم الآليات الفعالة لمواجهة أزمة العدالة الجنائية، والتي أغفلتها جل التشريعات العربية التي اتجهت نحو بدائل الدعوى العمومية بما فيها التشريع الجزائري في تبينيها لها كآلية بديلة لحل المنازعات الجنائية إلى جانب نظام الصلح الجنائي وكذلك نظام الوساطة الجزائية. وتهدف الدراسة إلى التعريف بالتسوية الجنائية وتسليط الضوء أحكامها من خلال التطرق لشروط اللجوء إليها وكذا نطاق تطبيقها وإجراءاتها والآثار القانونية المترتبة عليها، وكذلك دعوة المشرع الجزائري إلى ضرورة تبني نظام التسوية الجنائية وإقرارها كوسيلة بديلة لحل النزاعات الجنائية مهتديا بذلك بالتشريعات الجنائية المقارنة التي كانت سباقة لذلك.Criminal settlement is one of the modern and effective mechanisms for resolving criminal disputes that resulted from contemporary criminal policy in the context of its continuous endeavor to find means and solutions to alleviate the criminal justice crisis represented by the slow litigation procedures as a result of the massive increase in the number of cases brought before the criminal courts, by facilitating procedures and reducing The volume of low-risk cases brought before the criminal judiciary.
