كورونا من منظور الامن الانساني - مساهمة في رصد اثار الجائحة على حقوق المتقاضين

Abstract

تطرقنا في هذا المقال لموضوع كورونا من منظور الأمن الإنساني-مساهمة في رصد أثر الجائحة على حقوق المتقاضين- ، حيث إستهدفنا إبراز خصوصية فيروس كورونا المستجد (كوفيد-19)، و أثره على الأمن الإنساني بصفة عامة والأمن القانوني بصفة خاصة، والأمن القضائي بصفة أخص، وذلك على ضوء التشريع الجزائري في جانبه المتعلق بالمواعيد الإجرائية القضائية و أجال الطعون. وقد انتهجنا في بحثا هذا المنهج الوصفي التحليلي من أجل الإلمام بالموضوع من كافة جوانبه. وقد توصلنا إلى أن شروط القوة القاهرة تنطبق على فيروس كورونا كوفيد -19، كما توصلنا الى أن المشرع الإجرائي أشار إلى القوة القاهرة في العديد من مواده وذلك لحماية حقوق المتقاضين ذات الصلة بالمواعيد الإجرائية وآجال الطعون، غير أن النصوص التنظيمية كانت أكثر تفصيلا بهذا الشأن. In this article, we touched on the topic of Corona from the perspective of human security - a contribution to monitoring the impact of the pandemic on the rights of litigants - as we aimed to highlight the peculiarity of the emerging corona virus (COFED-19), and its impact on human security in general and legal security in particular, and judicial security in particular This is in light of the Algerian legislation on its side related to judicial procedural deadlines and the deadline for appeals. We have pursued this descriptive analytical approach in order to gain familiarity with the topic in all its aspects. We concluded that the conditions of force majeure apply to the Corona-Covid-19 virus, and we also concluded that the procedural legislator referred to force majeure in many of its articles in order to protect the rights of litigants related to procedural deadlines and appeals deadlines, but the regulatory texts were more detailed in this regard.
