النظام القانوني للدوائر الإنتخابية

Abstract

The division of constituencies, as a first fundamental stage of the electoral process in its broad sense, is related to an important principle called the principle of relative balance of the electoral vote. it is supposed that the application of this principle lead the number of voters who constitute one constituency to be approximately equal to the number of voters in other constituencies, which is ultimately reflected on the balance between all constituencies within the elected Legislative Council, and achieving that one requires impartial and effective justice during the division of constituencies process through a good selection of the body responsible for division, and surrounding this operation with the necessary guarantees, by examining the methods and means used in the division process and their effects, as well as the necessity to make the division process of electoral constituencies itself under the monitoring of a neutral body, and allow the public to contribut in such control, as it's the case in some similar systems, consequently it ensures the inviolability of the constitutional principles set forth in this framework. يرتبط تقسيم الدوائر الانتخابية، كمرحلة جوهرية ممهدة للعملية الانتخابية بمعناها الواسع بمبدأ مهم وهو مبدأ التوازن النسبي للصوت الانتخابي، حيث يفترض من تطبيق هذا المبدأ أن يكون عدد الناخبين الذين تتشكل منهم الدائرة الانتخابية الواحدة مساويا مساواة تقريبية لعدد الناخبين في الدوائر الأخرى، مما ينعكس في النهاية على التوازن داخل المجلس التشريعي المنتخب بين جميع الدوائر، ولتحقيق هذا الأمر يتطلب ذلك تفعيل العدالة والحياد أثناء عملية تقسيم الدوائر من خلال حسن اختيار الجهة المكلفة بالتقسيم وإحاطتها بالضمانات اللازمة، عن طريق التدقيق في الطرق والوسائل المتبعة في عملية التقسيم والآثار المترتبة عنها، فضلا على ضرورة إخضاع عملية تقسيم الدوائر الانتخابية نفسها إلى رقابة جهة محايدة والسماح للجمهور بالمساهمة في هذه الرقابة كما هو متبع في بعض الأنظمة المقارنة حتى تضمن عدم انتهاك المبادئ الدستورية المقررة في هذا الإطار.
